These terms and conditions govern the use of the www.masaimara.ke website and the booking of safari vehicle rental services offered by Kambu Campers Limited, Nairobi, Kenya. By accessing, browsing, or making a booking through this website, you agree to be bound by the following terms and conditions.
1. Definitions
- Company: Kambu Campers Limited
- Client: Any person, firm, or company contracting with the Company for the rental of safari vehicles or other associated services.
- Services: The rental of safari vehicles and any additional services provided by the Company, including but not limited to accommodation, transfers, and tours.
- Vehicle: Any safari vehicle offered by third-party owners listed on the Company’s platform, including 4×4 Land Cruisers, 2WD vehicles, campervans, and other rental vehicles suitable for safari use.
2. Ownership and Responsibility
Vehicles listed on the www.masaimara.ke platform are owned by independent third parties. Each vehicle owner may have their own terms and conditions, including insurance policies and liability coverages, which may differ from the general policies provided by Kambu Campers Limited. The Client acknowledges that, in the event of booking a vehicle, they are entering into an agreement with the third-party vehicle owner and are subject to their specific terms, in addition to those of Kambu Campers Limited.
3. Booking and Payment
- Deposit: A 50% deposit of the total booking cost is required at the time of booking to secure the reservation. This deposit must be received by the Company to confirm the booking.
- Balance Payment: The remaining 50% balance must be paid no later than 35 days before the commencement of the service. If the booking is made within 35 days of the service start date, the full amount is due at the time of booking.
- Failure to Pay: If full payment is not received by the specified due date, the Company reserves the right to cancel the booking, and cancellation charges will apply as per the cancellation policy below.
4. Cancellations and Refunds
- Cancellations 35 Days or More Before Start of Service: A 10% cancellation fee of the total booking amount will be charged to cover administrative costs.
- Cancellations Between 15 to 35 Days Before Start of Service: 35% of the total booking amount will be charged.
- Cancellations Between 5 to 14 Days Before Start of Service: 65% of the total booking amount will be charged.
- Cancellations Within 4 Days or Less Before Start of Service: 100% of the total booking amount will be charged.
- No Show: Failure to arrive on the day of the service will result in the full cost of the booking being charged without a refund.
Please note that cancellation during peak or festive periods (e.g., from 23rd December to 2nd January) may attract up to 100% cancellation fees regardless of the notice period due to high demand.
5. Vehicle Usage and Rental Conditions
- Vehicle Condition: All vehicles rented through the Company are maintained in roadworthy condition by their respective owners and meet the safety standards required for safari operations. The Client is responsible for inspecting the vehicle upon collection to ensure its condition is satisfactory.
- Self-Drive Requirements: Self-drive rentals are permitted, provided the Client meets the legal requirements for driving in Kenya and has sufficient experience with off-road driving. The use of 2WD vehicles for self-drive in the reserve is prohibited due to the rugged terrain.
- Fuel: Vehicles are provided with a fuel. The Company shall fuel the vehicle throughout your safari period.
- Driver-Guide Option: Clients may choose to hire a professional driver-guide from the Company or vehicle owner to operate the vehicle during the safari. The cost of the driver-guide service will be included in the rental agreement if selected.
- Off-Road Driving: Off-road driving is strictly prohibited in national parks and reserves, including Masai Mara, to preserve wildlife habitats and avoid vehicle damage. Any breach of this rule may result in fines or penalties, which will be the responsibility of the Client.
6. Insurance
- Third-Party and Comprehensive Insurance: Some vehicles listed on the platform may only carry third-party liability insurance, while others may have comprehensive insurance. The specific insurance coverage for each vehicle will be outlined in the rental agreement provided by the third-party vehicle owner.
- Excess Liability: The Client may be required to pay an excess liability amount in the event of an accident or damage, depending on the insurance policy provided by the vehicle owner. This excess liability ranges from $500 to $2,500, depending on the vehicle and insurance policy.
- Personal Travel Insurance: Clients are required to have personal travel insurance that covers medical emergencies, accidents, and baggage loss during the safari. The vehicle’s insurance does not cover personal injuries or lost personal belongings.
7. Vehicle Breakdown and Assistance
- Breakdown Support: In the event of a vehicle breakdown, the vehicle owner or the Company will provide roadside assistance or arrange for a replacement vehicle as quickly as possible. However, neither the vehicle owner nor the Company can be held responsible for delays or cancellations caused by vehicle issues beyond their control.
- Client Responsibility: The Client is responsible for the vehicle during the rental period and must ensure it is used in accordance with the terms of the rental agreement. Any negligent or reckless driving that results in damage to the vehicle will be the responsibility of the Client.
8. Liability
- Limitation of Liability: The Company’s liability is limited to the services provided under the rental agreement. The Company is not liable for delays, cancellations, or changes caused by factors beyond its control, including but not limited to weather conditions, road closures, wildlife disturbances, or park restrictions.
- Subcontractors: The Company or the third-party vehicle owner may engage subcontractors to provide certain services, such as accommodation or transportation. The same terms and conditions apply to any services provided by these subcontractors.
9. Price Adjustments
The Company reserves the right to adjust prices without prior notice in the following circumstances:
- Currency Fluctuations: Changes in exchange rates that affect the cost of services.
- Fuel Costs: Increases in the price of motor vehicle fuel or aviation fuel.
- Governmental Fees: Changes in national park entrance fees, taxes, or other statutory charges.
- Accommodation Costs: Increases in the cost of accommodation that form part of the safari package.
10. Park Fees and Permits
- Park Entry Fees: Park fees are not included in the vehicle rental cost unless explicitly stated in the booking confirmation. Clients are responsible for paying park entry fees directly to the relevant authorities.
- Permits: Clients must ensure they obtain the necessary permits for any specific activities within the park or reserve, such as camping or night game drives.
11. Amendments to Services
- Service Changes: The Company reserves the right to alter the itinerary, vehicle, or accommodation due to unforeseen circumstances. Where possible, the Company or vehicle owner will provide alternatives of equal value.
- Client-Initiated Changes: Any changes requested by the Client after confirmation of the booking may incur additional charges, subject to availability and approval by the Company or vehicle owner.
12. Governing Law
These terms and conditions are governed by the laws of Kenya, and any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Kenya.
